OLYMPLAND BUSINESS CONDITIONS - SPORTS CENTER
Article I.
INTRODUCTORY PROVISIONS
1. Business conditions. These terms and conditions (hereinafter referred to as "terms and conditions")
company PRATR as, ID: 25265687, VAT number: CZ25265687, N\u00e1chodsk\u00e1 524, 541 03 Trutnov, registered at the Regional Court in Hradec Kr\u00e1lov\u00e9, section B, file 1613, (hereinafter referred to as the "Operator") are regulated in accordance with the provisions of \u00a7 1751, paragraph 1 of the Act No. 89\/2012 Coll., the Civil Code (hereinafter referred to as the "Civil Code") mutual rights and obligations of the contracting parties in connection with the operation and provision of services by the Operator within the gym and all sports facilities in Olympland - sports center, at N\u00e1chodsk\u00e1 531 , 541 03 Trutnov, www.fitness.olympland.cz, hereinafter also referred to as "fitness center"
2.Olympland - sports center (partially self-service fitness center)
Olympland - sports center is a self-service fitness center, which operates during extended hours (5:00 am - 10:00 pm); the operating rules are available on the website.
Conditions for visiting the self-service fitness center are:
a) The customer must have an Olympland club card, which will be issued to him at the reception of the Olympland Hotel on the 1st floor,
b) The Customer signs and submits at the reception of the fitness center the conditions for the use of the fitness center, where he undertakes to comply with the conditions of the fitness center as set by the Operator,
c) A customer who does not have an Olympland club card issued can use the purchase of a one-time ticket in the automatic terminal before entering the fitness center. The customer undertakes to comply with the conditions of the fitness center when purchasing a ticket.
Detailed conditions are set out in the operating rules for self-service fitness and other documents that will be submitted to the customer at the reception of the fitness center on the basis of his request to establish the possibility to use self-service fitness.
3. Customer. Fitness center customer means a person who uses the services of the fitness center to the extent of his current offer, which is always listed on the website of the fitness center www.fitness.olympland.cz, ie mainly uses the services of the gym, halls for group lessons, sports fields, related parts of the fitness center and other related services (massages, etc.). The customer can use the services of the fitness center as his registered customer (who is entitled to draw benefits that the Provider reserves for registered customers on the basis of registration), or even without registration
4. Services. The range of services provided within the operation of fitness centers is always listed and updated on the website www.fitness.olympland.cz, including the current price list of individual services. To use some services, a previous online reservation is required according to the conditions specified in the reservation system at www.rezervace.olympland.cz. By registering, the customer provides the Provider with the necessary data, which serves for the proper fulfillment of the rights and obligations arising for the Provider from the provision of services within the fitness center in relation to the customer. Data processing is detailed in a separate part of these terms and conditions. The registration procedure is available at www.fitness.olympland.cz. If the visitor registers, he can use the services of fitness centers on favorable terms. When providing services within the fitness center (either with or without prior reservation), the provider is limited by the technical and capacity of the fitness center (in rare cases also by restrictions based on valid and effective legislation of the Czech Republic) and the customer therefore acknowledges that the offered services is conditioned by the Provider sufficient capacity. If the capacity is exhausted, it is not possible to register for services that require a reservation (group lessons, for example). The customer acknowledges that he is not entitled to claim any compensation for the impossibility of using the services in such a case due to full capacity or technical (or government) restrictions.
5. The wording of the business conditions may be changed or supplemented by the Operator. This provision does not affect the rights and obligations arising during the period of validity of the previous version of the terms and conditions of trade. The business conditions valid and effective at the time when the service is provided by the Provider to the customer apply to the contractual relationship between the Operator and the customer.
6. Business conditions are available on the website www.fitness.olympland.cz and within the online booking system. Upon request, they will be provided to the customer in printed form at the reception of the fitness center.
8. The customer who uses the services in the fitness center referred to in Article I, paragraph 1 of these terms and conditions declares that he has read these terms and conditions and undertakes to comply with them in the use of the fitness center services.
Article II.
PRICE OF GOODS AND PAYMENT TERMS
1. The price of services (or goods) is listed for each service on the website www.fitness.olympland.cz so that the basic price is always stated and in the individual variants listed below ad a to c the discounted price is also stated.
The customer can use and pay for the services provided in the following ways:
a) by purchasing a season ticket according to the current conditions stated on the fitness center's website;
b) purchasing a fitness center membership;
c) by paying a deposit, from which it then draws services (or products) under favorable conditions
d) in cash once at the hotel reception (including payment by credit card).
Methods a) - c) can be purchased both at the hotel reception and online at www.rezervace.olympland.cz. The procedure is always given within the application or on the website www.fitness.olympland.cz.
The customer chooses the option of payment for the services drawn before starting to use them and acknowledges that it is not possible to change the option after purchase (except in the case described below in this article - deposit).
2. Passes:
The current offer of season tickets is always listed on the website, which can be used to subscribe to the gym (or for group lessons, solarium). Season ticket prices depend on the number of purchased tickets and their current price list is available at www.fitness.olympland.cz.
Passes entitle the holder to enter the selected service (according to the type of season ticket) and are sold for the number of entries.
The validity of the purchased season ticket is 6 months from its purchase. The customer is obliged to purchase a season ticket that takes into account his exercise plan so that he can exhaust it within 6 months.
If the inputs are not used up, they are forfeited after 6 months and are non-refundable. The customer acknowledges that he is not entitled to demand any compensation or reimbursement for unspent entries after the expiration of 6 months from the purchase of the season ticket.
The pass is portable, it is not tied to a specific customer.
With each input resp. using the service, one entry is deducted from the purchased season ticket.
The pass is not used to purchase goods for sale at the fitness center reception; serves only for drawing the selected service under favorable conditions.
The customer acknowledges that even if he is entitled to a certain number of inputs or. use of selected services within the fitness center, the delivery of these services by the Provider is, as in other cases, conditioned by the sufficient capacity of the fitness center. The purchase of a season ticket does not entitle you to preferential use of fitness center services without another customer. The advantage of a season ticket is that the member uses the services based on the season ticket in a discounted way, but to the extent and in the way that the capacity of the fitness center allows. The customer is obliged to take this fact into account when selecting and choosing the appropriate form of payment from the fitness center service used.
3. Membership:
On the website www.fitness.olympland.cz. the current conditions for purchasing membership in the fitness center are always stated. Membership entitles you to purchase discounted season tickets.
Membership is set up for a specific customer and is non-transferable.
By acquiring a fitness center membership, the Customer consents to the Provider processing its personal data in connection with the management of its member account, to the extent necessary to fulfill the rights and obligations arising from the contractual relationship between the Provider and the customer.
The validity of the membership is agreed for a certain period of time according to the customer's choice from the offer at www.fitness.olympland.cz, or on the basis of individually agreed conditions with the customer.
The customer is not entitled to a refund of the paid membership fee, if for any reason he cannot \/ does not want to use the membership, he is not entitled to any non-use of the paid membership fee for the period for which the membership was established. The amount paid for membership is non-refundable. Membership in the fitness center does not apply to the purchase of goods sold in the fitness center, nor to the use of group lessons provided by the fitness center.
4. Credit.
Options for topping up the credit and the related discounts on the prices of the services provided are listed and continuously updated at www.fitness.olympland.cz.
The credit entitles the customer to use all services (including the purchase of goods) provided by the Provider within the fitness center on favorable terms (except for goods), with the benefit depending on the amount of credit the customer purchases on his account. After each entry, the discounted entry amount is deducted from the credit.
The credit has unlimited validity. In the event that the customer wants to repay the unused credit at any time during its existence, the remaining credit will be unilaterally paid to him by the Operator. The administrative fee for the payment of credit (including the calculation of the price of services according to the previous paragraph) is charged a one-time amount of CZK 500.
If after 1 year there is still some amount left from the credit (the credit has no limited validity, it does not lapse in favor of the Operator), the customer will be deducted the use of services at full price according to the current price list until the credit is fully used up. In the event that the customer wants to pay the credit after 1 year from its deposit into the account, the payment is charged in a lump sum of CZK 500.
The credit is transferable; the customer can allow the use of their credit to anyone who provides registration details to identify the credit when entering the fitness center at the reception. The customer is responsible for who he makes the data available to use the credit. The Provider is not responsible for any misuse.
Purchase of credit is possible in person at the hotel reception, or. online after logging in to your account (the procedure is at www.fitness.olympland.cz). The credit is credited after the payment of the amount of money (it can be checked in your account).
Article III.
RIGHTS AND OBLIGATIONS OF FITNESS CENTER VISITORS
1. By entering the fitness center, the visitor confirms that he \/ she is medically fit to exercise, provided that he \/ she performs this exercise at his \/ her own risk. The operator of the fitness center is not responsible for any injuries that the visitor causes in the gym, whether during the exercise, in connection with it or outside it, regardless of whether the injury is caused during the exercise using exercise equipment or aids. By entering the gym, each visitor confirms that he has been acquainted by the Operator with the operation of the gym, with the individual exercise equipment and aids and with how they are used, and the visitor understands all these facts and circumstances. If you are unsure about the staff and the use of exercise equipment, they will turn to a coach or other professionally qualified person who is present at the hotel reception and can provide customers with appropriate support. The customer can also (for a fee according to the current price list) request assisted training (exercise plan) with a coach. Visitors are not allowed to bring their own fitness trainer to the fitness center.
2. Customers may not use the premises of the fitness center for their own commercial gainful activity, ie in particular to bring their own clients to the premises of the fitness center and provide them with personal fitness training, unless otherwise agreed with the Provider in advance.
3. Visitors are not allowed to bring their own drinks to the fitness center and consume their own food.
4. The visitor is obliged to respect the instructions of persons acting on behalf of the Provider (persons present at the hotel reception) and to comply with all rules and obligations set out in these conditions.
5. To attend organized lessons under the guidance of coaches, prior online or telephone reservation of a free term is required (due to limited capacity). The reservation can be canceled without penalty up to 6 hours before it starts; if the lesson is canceled later, the payment for participation will be forfeited (deducted from the season ticket or credit), regardless of the reason for which the customer did not participate. The amount the cancellation fee corresponds to the price of the organized lesson without taking into account the discount that is provided to the customer depending on his conditions (the cancellation fee may be higher than the amount the customer would pay to use the organized lesson).
6. Fitness center customers are obliged to behave in such a way that no damage occurs to the Operator's property or to the health of other customers, and at the same time they are obliged to behave in such a way as to prevent the occurrence of such possible damage.
7. Every customer of the fitness center is obliged to take off his shoes immediately after entering the gym and put on clean sports shoes, the sole of which does not leave any traces.
8. Every customer of the fitness center is obliged to observe the usual basic hygienic rules (especially in the areas of changing rooms, showers and toilets) associated with sports activities and the use of equipment and aids designed by the operator for use in sports. Disinfectants are available in the gym, with the use of which each visitor is obliged to adequately clean the sports equipment, machines, etc. used by him after the end of the exercise.
9. Every visitor to the gym is obliged to return the sports equipment used to their place (clean them) after the exercise.
10. There is a bar for every gym visitor. Every visitor to the gym is obliged to clean his drinking glasses and other utensils at the reception after the exercise.
11. If any visitor to the gym finds any defect or damage both on the gym building and on things in the gym, he is obliged to immediately inform the Operator through the person present at the reception of the fitness center so that the defect can be resolved immediately, or. in order to prevent \/ limit the use of the defective machine by the provider. In the event that the defect is caused by the visitor, he is obliged to compensate the Operator in full.
12. The visitor undertakes to use the exercise machines exclusively for the purpose for which they are intended and in a manner that does not damage the exercise machine. The visitor is obliged to use dumbbells and other weights only in the area reserved for this purpose (specially adapted), and he must not lift the dumbbells outside these areas. When lifting dumbbells and placing them with them, the visitor does not throw them uncontrollably and does not lower them in such a way as to disturb everyone in the fitness center with noise from their dropping, or ruined the floor of the fitness center. The visitor is obliged to always use safety fuses and closures if they are on fitness machines.
13. There is a strict ban on the consumption of alcoholic beverages, narcotics and psychotropic substances in all areas of the fitness center (both the gym and changing rooms, toilets, showers, etc.) and there is a strict ban on smoking everywhere.
14. It is strictly forbidden to bring dangerous substances (poisons, explosives, weapons, knives, chemicals, flammables, etc.) and all other objects that are capable of endangering other visitors to the fitness center.
15. Lockers are available for visitors to store clothes during their presence in the fitness center. Upon leaving the fitness center, the visitor is obliged to empty the locker and leave it unlocked for use by other visitors. The visitor is responsible for the loss, damage or destruction of stored items. The visitor acknowledges that the locker is only for storing clothes. If the visitor is interested in long-term rental of the locker, it is possible to do so on the basis of an agreement with the Provider and under the conditions according to the current price list available at the reception of the fitness center. The user of the box is obliged to make it available to the Provider at any time upon his request so that the Provider can check its contents (whether it contains anything that would violate the visitor's terms and conditions, or generally binding legal regulations).
16. Bringing valuables, resp. values, which in total have a value of over CZK 5,000, is exclusively at your own risk in the fitness center and the Provider does not generally recommend such the introduction of valuables. In exceptional cases, if necessary, the visitor will store valuables at the reception staff, where there are safes in which such valuables will be stored during the visitor's training. The Provider is in no way responsible for the loss or destruction of such valuables, which the visitor does not store at the reception according to the previous sentence.
17. Visitors to the fitness center acknowledge that in order to protect the Operator's property, protect visitors' property, protect the life and health of visitors and to monitor compliance with the fitness center operating rules (rules of conduct for visitors specified in these terms and conditions) the operator installed CCTV.
18. The age limit for setting up a gym is 18 years. If the person is under the age of 18, they are only allowed access to the gym if they are accompanied by a person over the age of 18 who takes full responsibility for the child. The fitness center is dangerous for small children and therefore unsuitable. If a visitor to the gym brings a small child, he is obliged to prevent him from moving freely in the gym area, climbing on exercise machines, or disturbed other visitors from using the gym's services. If the Provider allows access to a person under the age of 18 (eg with the consent of a legal representative), the Provider does not assume any responsibility for these persons (even within organized group hours).
19. For the exercise, each visitor is obliged to use his own towel, which for hygienic reasons he places under himself on the seating and support surfaces of the fitness machines. If you forget the towel, you can borrow it at the hotel reception for a fee. If the visitor does not use the towel, he will be notified of the breach of duty and in the extreme case he may be excluded from the fitness center for breach of the rules of conduct.
20. In the event that any visitor to the gym violates any of the obligations set out in this article of the Terms and Conditions, even in only one case, the operator is entitled to permanently deny and prevent that visitor's access to the fitness center premises without compensation. This fact will also be notified to him by e-mail sent to the e-mail address, if he stated it during registration.
21. If a visitor commits inappropriate behavior towards other visitors, or to the fitness center staff, the Provider (or any person authorized by it) is entitled to expel the visitor from the fitness center once or permanently, without the right to compensation or refund of the paid entrance fee (regardless of its form, this measure applies to season tickets, membership , so steal). Such conduct means, for example, the use of rude, offensive, hurtful and vulgar words, harassment of other visitors, indecent or even disrespectful allusions to other visitors, or staff etc ..
22. Visitors are obliged to terminate their activities in the fitness center by leaving the fitness center (including the changing room) by the end of the opening hours at the latest.
23. The Provider reserves the right to adjust the conditions for entry to the fitness center and the rights and obligations in the use of services in connection with its operation.
24. The Provider does not provide its visitors with full parking capacity, the right to parking or its compensation does not arise.
25. The Provider is not liable for any damage to property or health that the visitor causes intentionally, negligently or carelessly, or in connection with an overestimation of his abilities or underestimation of his health condition. It is not responsible even if the visitor does not follow the principles of proper handling of tools or machines and thus endangers (or causes damage or injury) to another visitor.
26. The Provider reserves the right to limit or extend the opening hours of the fitness center at its own discretion, and is entitled, in justified cases, to temporarily limit or interrupt the operation of the fitness center. Changes in opening hours are not a reason to provide any compensation to visitors, or to reduce or refund membership fees or pay out credit.
27. In the event of an extraordinary, unpredictable and insurmountable obstacle, which arose independently of the Provider's will (force majeure), the Provider reserves the right to close the fitness center without further assistance, for a period appropriate to the situation (in whole or in part) and to terminate immediate effect. The customer is not entitled to a refund or refund of fees already paid. The customer acknowledges that any measures (governments, ministries, etc.) issued in connection with the COVID - 19 pandemic are considered force majeure and are subject to this provision.
28. In the event of a circumstance that temporarily prevents the Provider from providing services under these terms and conditions, this does not affect the rights and obligations of customers and is not a reason to reduce or refund the price paid for services or membership fees or termination of the contract by the customer. Insufficient capacity of the fitness center (eg due to capacity limitations based on government measures) or technical problems that would limit or eliminate the use of some services are considered to be serious problems.
29. \u00a0In case of repeated non-use of the reserved sports venue, the account and membership may be cancelled. Make a reservation only for the period of use, and if you do not arrive, please cancel the reservation and make room for others.<\/span><\/p>\n

TERMS AND CONDITIONS AND RULES OF THE RESERVATION SYSTEM<\/p>\n

Our online reservation system will simplify the management of your reservations. At the same time, you will have an overview of the drawdown of credit or a season ticket.
You will always be immediately informed about everything happening on the account you created to the registered email. You will be informed about some services by SMS to a registered mobile phone.
Without registration, it is not possible to use the services of the reservation system. Unless special lessons \/ reservations are set up.
Terms of registration
Before registering, read the conditions and rules of the reservation system and the operating rules of our establishment. By registering in the reservation system, you confirm that you are familiar with the operating rules and agree to comply with them.
We reserve the right to cancel your registration if you violate the rules of operation.
Registration procedure
You can do the basic registration on the website of the reservation system.
After opening the page, click on the "Register" box. After filling in the fields (marked with *, they are mandatory) and then saving, a confirmation email will be sent to the specified email address. You need to log in to your email and immediately confirm the email by clicking on the received link. This completes the registration.

\u2022 the letter "R" will appear in the window of your chosen activity in the calendar after a successful reservation, at the same time a message will be sent to your email address with information about the reservation made
\u2022 in exceptional cases, the reservation can be made by agreement at the reception
\u2022 if there is not a sufficient number of registered clients at the time of registration, the red inscription Lesson is not yet open will be lit in the reservation window. Missing bookings: x In the calendar field, this is shown as a yellow triangle with a black exclamation point.<\/p>\n

Cancellation terms and penalties
Only the registered client who made the reservation can cancel the reservation. Most lessons have their own penalty zone, i.e. the time before the lesson, when the cancellation of the lesson is already penalized. If you cancel the reservation before the penalty zone, the system will return the entire credit or access to the season ticket. If you cancel the reservation in the penalty zone, the system no longer refunds the credit or admission to the season ticket (it may refund part of the credit\/admission, depending on the system settings). Penalty zone is indicated next to the lesson (displayed after hovering the mouse over the lesson)<\/p>\n

Cancellation procedure
\u2022 log in to the reservation system
\u2022 place the mouse cursor on the lesson in the calendar you are signed up for, or click on the lesson and then click Cancel reservation
\u2022 you will be informed immediately (an information field will appear at the top of the page for a short time) \u2013 the cancellation of the reservation was successful, or the cancellation of the reservation was successful \u2013 PENALTY
\u2022 the letter "R" disappears in the window of your chosen activities in the calendar after successful cancellation of the reservation, at the same time a message is sent to your email address with information about the cancellation of the reservation
\u2022 the lesson will be canceled automatically if the condition of the set minimum number of registered clients is not met (the minimum number is always indicated in the detail of the activity in the calendar schedule). When the lesson is automatically cancelled, the credit \/ entry is automatically assigned back to your account.
Substitute Terms
You can apply for a substitute position no later than X hours before the start of the selected activity. After this time limit, you cannot sign in as a substitute, nor will you be automatically moved to the vacated spot of an active client.
If a place becomes available on the selected activity before the 1-hour time limit, the system automatically moves you from a substitute to an active client and your credit or entry is automatically withdrawn.
Conditions of the credit system and credit top-up procedure
The credit can be topped up at the reception of our center. The minimum amount for top-up credit is CZK 200.
Credit is valid for 12 months from top-up. The minimum amount for credit extension is\u00a0<\/p>\n

Article IV.
PROTECTION OF PERSONAL DATA
1. Processing of personal data. The Provider informs the customer that it only processes such personal data about the customer as are necessary to fulfill the rights and obligations arising for the seller from the law and the concluded contract between the Provider and the customer. This will usually involve the processing of the following personal data: name and surname, residential address, e-mail address, telephone number.
2. Personal data of the customer. The Customer acknowledges that he is obliged to state his personal data (during registration, in his user account, etc.) correctly and truthfully and that he is obliged to inform the Provider without undue delay about the change in his personal data. Detailed information on the processing of personal data by the Provider is provided in the document "Information on the processing of personal data", which is available on the seller's website www.fitness.olympland.cz.
3. Camera system. The Customer, as a visitor of the fitness center, acknowledges that in order to protect the rights and legitimate interests of the Provider (protection of property, protection of life and health of persons, control of compliance with fitness center rules, etc.) and to protect visitors to the fitness center, cameras are placed in training areas. . The documentation of the camera system is available for inspection at the reception of the fitness center. The main purpose of the introduction of a camera system is the possible acquisition of evidence for possible subsequent use by the Provider to protect and assert its legitimate interests (protection of the Provider's property, protection of life and health of persons using the self-service fitness center, violation of fitness rules and related risks in to the persons as well as to the Provider's property) and to the subsequent use of the obtained data \/ evidence to assert the Provider's legal claims before the Czech Police (including other public administration bodies) in detecting criminal offenses and misdemeanors, or in front of the insurance company. With regard to the values that are protected by CCTV monitoring (health and life of fitness center visitors, protection of the Provider's property against theft or destruction), and with regard to the scope and value of the Provider's assets, the use of CCTV monitoring appears appropriate, and even taking into account the protection of the rights and legitimate interests of visitors to the Provider's fitness center for the protection of privacy and personal data, which are investigated as much as possible within all measures taken. The Provider considers that the operation of the camera system will also significantly increase the safety of visitors and prevent the movement of strangers (unauthorized persons) in the Provider's fitness center. The visitor acknowledges that the camera system is used in the fitness center and by entering the fitness center and using its services, agrees to the location of the camera system, its use and processing of personal data for the purposes specified in this paragraph.
Article V.
DELIVERY
The buyer agrees that communication between the seller and the buyer will take place, among other ways, electronically, through the e-mail address provided by the buyer when concluding the purchase contract. This communication is considered sufficient.
Article VI.
FINAL PROVISIONS

In order for your complaint to be resolved as quickly as possible, please observe the following steps.

Z\u00e1kazn\u00edk se zavazuje dodr\u017eovat podm\u00ednky fitness centra p\u0159i n\u00e1kupu vstupenky.\r\nBli\u017e\u0161\u00ed podm\u00ednky jsou stanoveny v provozn\u00edm \u0159\u00e1du pro samoobslu\u017en\u00e9 fitness a dal\u0161\u00edch dokumentech, kter\u00e9 budou z\u00e1kazn\u00edkovi na z\u00e1klad\u011b jeho po\u017eadavku ke z\u0159\u00edzen\u00ed mo\u017enosti vyu\u017e\u00edvat samoobslu\u017en\u00e9 fitness p\u0159edlo\u017eeny na recepci fitness centra\r\n3. Z\u00e1kazn\u00edk. Z\u00e1kazn\u00edkem fitness centra se rozum\u00ed osoba, kter\u00e1 vyu\u017e\u00edv\u00e1 slu\u017eeb fitness centra v rozsahu dle jeho aktu\u00e1ln\u00ed nab\u00eddky, kter\u00e1 je v\u017edy uvedena na webov\u00fdch str\u00e1nk\u00e1ch fitness centra www.fitness.olympland.cz, tj. zejm\u00e9na vyu\u017e\u00edv\u00e1 slu\u017eeb posilovny, s\u00e1l\u016f pro hromadn\u00e9 lekce, sportovi\u0161\u0165, souvisej\u00edc\u00edch \u010d\u00e1st\u00ed fitness centra a dal\u0161\u00edch souvisej\u00edc\u00edch slu\u017eeb (mas\u00e1\u017ee atd.). Z\u00e1kazn\u00edk m\u016f\u017ee slu\u017eby fitness centra vyu\u017e\u00edvat jako jeho registrovan\u00fd z\u00e1kazn\u00edk (kter\u00fd je na z\u00e1klad\u011b registrace opr\u00e1vn\u011bn \u010derpat v\u00fdhody, kter\u00e9 Poskytovatel vyhrazuje pro registrovan\u00e9 z\u00e1kazn\u00edky), p\u0159\u00edpadn\u011b i bez registrace\r\n4. Slu\u017eby. Rozsah slu\u017eeb poskytovan\u00fdch v r\u00e1mci provozu fitness center je v\u017edy uveden a aktualizov\u00e1n na webov\u00fdch str\u00e1nk\u00e1ch www.fitness.olympland.cz, a to v\u010detn\u011b aktu\u00e1ln\u00edho cen\u00edku jednotliv\u00fdch slu\u017eeb. K vyu\u017eit\u00ed n\u011bkter\u00fdch slu\u017eeb se vy\u017eaduje p\u0159edchoz\u00ed on-line rezervace dle podm\u00ednek uveden\u00fdch v rezerva\u010dn\u00edm syst\u00e9mu na www.rezervace.olympland.cz. Registrac\u00ed poskytuje z\u00e1kazn\u00edk Poskytovateli nezbytn\u00e9 \u00fadaje, kter\u00e9 slou\u017e\u00ed pro \u0159\u00e1dn\u00e9 napln\u011bn\u00ed pr\u00e1v a povinnost\u00ed vypl\u00fdvaj\u00edc\u00edch pro Poskytovatele z poskytov\u00e1n slu\u017eeb v r\u00e1mci fitness centra ve vztahu k z\u00e1kazn\u00edkovi. Zpracov\u00e1n\u00ed \u00fadaj\u016f je rozvedeno v samostatn\u00e9 \u010d\u00e1sti t\u011bchto obchodn\u00edch podm\u00ednek. Postup pro registraci je uveden na www.fitness.olympland.cz. Pokud se n\u00e1v\u0161t\u011bvn\u00edk registruje, m\u016f\u017ee slu\u017eeb fitness center vyu\u017e\u00edvat za zv\u00fdhodn\u011bn\u00fdch podm\u00ednek. Poskytovatel je p\u0159i poskytov\u00e1n\u00ed slu\u017eeb v r\u00e1mci fitness centra (a\u0165 u\u017e s p\u0159edchoz\u00ed rezervac\u00ed \u010di bez n\u00ed) omezen technick\u00fdmi i kapacitn\u00edmi mo\u017enostmi fitness centra (v ojedin\u011bl\u00fdch p\u0159\u00edpadech i omezen\u00edmi vych\u00e1zej\u00edc\u00edmi z platn\u00e9 a \u00fa\u010dinn\u00e9 legislativy \u010cR) a z\u00e1kazn\u00edk proto bere na v\u011bdom\u00ed, \u017ee poskytnut\u00ed nab\u00edzen\u00fdch slu\u017eeb je ze strany Poskytovatele podm\u00edn\u011bno dostate\u010dnou kapacitou. Pokud je kapacita vy\u010derp\u00e1na, nen\u00ed mo\u017en\u00e9 se na slu\u017eby, kter\u00e9 rezervaci vy\u017eaduj\u00ed (skupinov\u00e9 lekce nap\u0159.), p\u0159ihl\u00e1sit. Z\u00e1kazn\u00edk bere na v\u011bdom\u00ed, \u017ee nen\u00ed opr\u00e1vn\u011bn po\u017eadovat v takov\u00e9m p\u0159\u00edpad\u011b jakoukoli kompenzaci za nemo\u017enost vyu\u017eit\u00ed slu\u017eeb z d\u016fvodu pln\u00e9 kapacity \u010di technick\u00fdch (nebo vl\u00e1dn\u00edch) omezen\u00ed.\r\n5. Zn\u011bn\u00ed obchodn\u00edch podm\u00ednek m\u016f\u017ee Provozovatel m\u011bnit \u010di dopl\u0148ovat. T\u00edmto ustanoven\u00edm nejsou dot\u010dena pr\u00e1va a povinnosti vznikl\u00e1 po dobu \u00fa\u010dinnosti p\u0159edchoz\u00edho zn\u011bn\u00ed obchodn\u00edch podm\u00ednek obchodu. Na smluvn\u00ed vztah Provozovatele a z\u00e1kazn\u00edka se aplikuj\u00ed obchodn\u00ed podm\u00ednky platn\u00e9 a \u00fa\u010dinn\u00e9 v dob\u011b, kdy se slu\u017eba ze strany Poskytovatele z\u00e1kazn\u00edkovi poskytuje.\r\n6. Obchodn\u00ed podm\u00ednky jsou dostupn\u00e9 na webov\u00fdch str\u00e1nk\u00e1ch www.fitness.olympland.cz i v r\u00e1mci rezerva\u010dn\u00edho on-line syst\u00e9mu. Na vy\u017e\u00e1d\u00e1n\u00ed budou z\u00e1kazn\u00edkovi poskytnuty v ti\u0161t\u011bn\u00e9 form\u011b na recepci fitness centra.\r\n8. Z\u00e1kazn\u00edk, kter\u00fd \u010derp\u00e1 slu\u017eby ve fitness centru uveden\u00e9m v \u010dl\u00e1nku I odst. 1 t\u011bchto obchodn\u00edch podm\u00ednek prohla\u0161uje, \u017ee se sezn\u00e1mil s t\u011bmito obchodn\u00edmi podm\u00ednkami a zavazuje se je v r\u00e1mci \u010derp\u00e1n\u00ed slu\u017eeb fitness centra dodr\u017eovat.\r\n\u010cl\u00e1nek II.\r\nCENA ZBO\u017d\u00cd A PLATEBN\u00cd PODM\u00cdNKY\r\n1. Cena slu\u017eeb (p\u0159\u00edp. zbo\u017e\u00ed) je pro ka\u017edou slu\u017ebu uvedena na webov\u00fdch str\u00e1nk\u00e1ch www.fitness.olympland.cz tak, \u017ee je v\u017edy uvedena cena z\u00e1kladn\u00ed a u jednotliv\u00fdch variant uveden\u00fdch n\u00ed\u017ee ad a a\u017e c je uvedena i cena zv\u00fdhodn\u011bn\u00e1.\r\nZ\u00e1kazn\u00edk m\u016f\u017ee vyu\u017e\u00edvat a hradit poskytovan\u00e9 slu\u017eby n\u00e1sleduj\u00edc\u00edmi zp\u016fsoby:\r\na) po\u0159\u00edzen\u00edm permanentky dle aktu\u00e1ln\u00edch podm\u00ednek uveden\u00fdch na webov\u00fdch str\u00e1nk\u00e1ch fitness centra;\r\nb) zakoupen\u00edm \u010dlenstv\u00ed ve fitness centru;\r\nc) uhrazen\u00edm depozitu, ze kter\u00e9ho pak \u010derp\u00e1 slu\u017eby (p\u0159\u00edp. i v\u00fdrobky) za zv\u00fdhodn\u011bn\u00fdch podm\u00ednek\r\nd) v hotovosti jednor\u00e1zov\u011b na recepci hotelu (v\u010detn\u011b \u00fahrady platebn\u00ed kartou).\r\nZp\u016fsoby a) \u2013 c) je mo\u017en\u00e9 zakoupit jako na recepci hotelu, tak online na www.rezervace.olympland.cz. Postup je v\u017edy uveden v r\u00e1mci aplikace, nebo p\u0159\u00edpadn\u011b na webov\u00fdch str\u00e1nk\u00e1ch www.fitness.olympland.cz.\r\nZ\u00e1kazn\u00edk zvol\u00ed variantu \u00fahrady \u010derpan\u00fdch slu\u017eeb p\u0159ed zapo\u010det\u00edm jejich \u010derp\u00e1n\u00ed a bere na v\u011bdom\u00ed, \u017ee po zakoupen\u00ed nen\u00ed mo\u017en\u00e9 zvolenou variantu m\u011bnit (s v\u00fdjimkou p\u0159\u00edpadu uveden\u00e9ho n\u00ed\u017ee v tomto \u010dl\u00e1nku- depozit).\r\n2. Zakoupen\u00ed permanentky neoprav\u0148uje bez dal\u0161\u00edho z\u00e1kazn\u00edka k p\u0159ednostn\u00edmu vyu\u017e\u00edv\u00e1n\u00ed slu\u017eeb fitness centra. V\u00fdhoda permanentky spo\u010d\u00edv\u00e1 v tom, \u017ee \u010dlen vyu\u017e\u00edv\u00e1 slu\u017eby na z\u00e1klad\u011b permanentky zv\u00fdhodn\u011bn\u011b, ale to v rozsahu a zp\u016fsobem, kter\u00fd kapacita fitness centra umo\u017e\u0148uje. Tuto skute\u010dnost je z\u00e1kazn\u00edk povinen zohlednit p\u0159i v\u00fdb\u011bru a volb\u011b p\u0159\u00edslu\u0161n\u00e9 formy \u00fahrady ze vyu\u017e\u00edvan\u00e9 slu\u017eby fitness centra.\r\n3. \u010clenstv\u00ed:\r\nNa webov\u00fdch str\u00e1nk\u00e1ch www.fitness.olympland.cz. jsou v\u017edy uvedeny aktu\u00e1ln\u00ed podm\u00ednky zakoupen\u00ed \u010dlenstv\u00ed ve fitness centru. \u010clenstv\u00ed oprav\u0148uje k n\u00e1kupu zv\u00fdhodn\u011bn\u00fdch permanentek.\r\n\u010clenstv\u00ed se z\u0159izuje pro konkr\u00e9tn\u00edho z\u00e1kazn\u00edka a je nep\u0159enositeln\u00e9.\r\nZ\u00e1kazn\u00edk ud\u011bluje po\u0159\u00edzen\u00edm \u010dlenstv\u00ed ve fitness centru sv\u016fj souhlas s t\u00edm, aby Poskytovatel zpracoval v souvislosti s veden\u00edm jeho \u010dlensk\u00e9ho \u00fa\u010dtu jeho osobn\u00ed \u00fadaje, a to v nezbytn\u00e9m rozsahu k napln\u011bn\u00ed pr\u00e1v a povinnost\u00ed plynouc\u00edch ze smluvn\u00edho vztahu Poskytovatele a z\u00e1kazn\u00edka.\r\nPlatnost \u010dlenstv\u00ed se sjedn\u00e1v\u00e1 na ur\u010ditou dobu dle v\u00fdb\u011bru z\u00e1kazn\u00edka z nab\u00eddky na www.fitness.olympland.cz, p\u0159\u00edp. na z\u00e1klad\u011b individu\u00e1ln\u011b sjednan\u00fdch podm\u00ednek se z\u00e1kazn\u00edkem.\r\nZ\u00e1kazn\u00edk nem\u00e1 n\u00e1rok na vr\u00e1cen\u00ed uhrazen\u00e9 \u010d\u00e1stky za \u010dlenstv\u00ed, pokud z jak\u00e9hokoli d\u016fvodu nem\u016f\u017ee\/nechce \u010dlenstv\u00ed vyu\u017e\u00edvat, nem\u00e1 ani n\u00e1rok za p\u0159\u00edpadn\u00e9 nevyu\u017eit\u00ed uhrazen\u00e9ho \u010dlensk\u00e9ho poplatku za dobu na kterou bylo \u010dlenstv\u00ed z\u0159\u00edzeno. Uhrazen\u00e1 \u010d\u00e1stka za \u010dlenstv\u00ed je nevratn\u00e1. \u010clenstv\u00ed ve fitness centru se net\u00fdk\u00e1 n\u00e1kupu zbo\u017e\u00ed prod\u00e1van\u00e9ho ve fitness centru, ani vyu\u017e\u00edv\u00e1n\u00ed skupinov\u00fdch lekc\u00ed realizovan\u00fdch fitness centrem. \r\n4. Po ka\u017ed\u00e9m vstupu je z kreditu ode\u010d\u00edt\u00e1na zv\u00fdhodn\u011bn\u00e1 \u010d\u00e1stka za vstup.\r\nKredit m\u00e1 neomezenou platnost. V p\u0159\u00edpad\u011b, \u017ee bude z\u00e1kazn\u00edk cht\u00edt nevy\u010derpan\u00fd kredit kdykoli po dobu jeho existence vyplatit zp\u011bt, zb\u00fdvaj\u00edc\u00ed kredit mu bude ze strany Provozovatele jednostrann\u011b vyplacen. Administrativn\u00ed poplatek za vyplacen\u00ed kreditu(v\u010detn\u011b dopo\u010dten\u00ed ceny slu\u017eeb dle p\u0159edchoz\u00edho odstavce) je zpoplatn\u011bno jednor\u00e1zovou \u010d\u00e1stkou ve v\u00fd\u0161i 500,--K\u010d.\r\nPokud po uplynut\u00ed 1 roku z kreditu je\u0161t\u011b n\u011bjak\u00e1 \u010d\u00e1stka zb\u00fdv\u00e1 (kredit nem\u00e1 omezenou platnost, nepropad\u00e1 ve prosp\u011bch Provozovatele), bude z\u00e1kazn\u00edkovi ode\u010d\u00edt\u00e1no \u010derp\u00e1n\u00ed slu\u017eeb v pln\u00e9 cen\u011b dle aktu\u00e1ln\u00edho cen\u00edku a\u017e do \u00fapln\u00e9ho vy\u010derp\u00e1n\u00ed kreditu. V p\u0159\u00edpad\u011b, \u017ee bude z\u00e1kazn\u00edk cht\u00edt kreditvyplatit po uplynut\u00ed 1 roku od jeho vlo\u017een\u00ed na \u00fa\u010det, je vyplacen\u00ed zpoplatn\u011bno jednor\u00e1zovou \u010d\u00e1stkou ve v\u00fd\u0161i 500,--K\u010d.\r\nKredit je p\u0159enosn\u00fd; z\u00e1kazn\u00edk m\u016f\u017ee umo\u017enit vyu\u017e\u00edv\u00e1n\u00ed sv\u00e9ho kreditu komukoli, kdo uvede registra\u010dn\u00ed \u00fadaje pro identifikaci kreditu p\u0159i vstupu do fitness centra na recepci. Z\u00e1kazn\u00edk si s\u00e1m odpov\u00edd\u00e1 za to, komu zp\u0159\u00edstupn\u00ed \u00fadaje pro vyu\u017eit\u00ed kreditu. Za p\u0159\u00edpadn\u00e9 zneu\u017eit\u00ed neodpov\u00edd\u00e1 Poskytovatel.\r\nN\u00e1kup kreditu je mo\u017en\u00fd osobn\u011b na recepci hotelu, p\u0159\u00edp. on-line po p\u0159ihl\u00e1\u0161en\u00ed do sv\u00e9ho \u00fa\u010dtu (postup je na www.fitness.olympland.cz). Kredit je p\u0159ips\u00e1n po uhrazen\u00ed pen\u011b\u017en\u00ed \u010d\u00e1stky (je mo\u017eno zkontrolovat na sv\u00e9mu \u00fa\u010dtu).\r\n\u010cl\u00e1nek III.\r\nPR\u00c1VA A POVINNOSTI N\u00c1V\u0160T\u011aVN\u00cdK\u016e FITNESS CENTRA\r\n1. Ji\u017e samotn\u00fdm vstupem do prostor fitness centra n\u00e1v\u0161t\u011bvn\u00edk potvrzuje, \u017ee je zdravotn\u011b zp\u016fsobil\u00fd ke cvi\u010den\u00ed s t\u00edm, \u017ee toto cvi\u010den\u00ed prov\u00e1d\u00ed na vlastn\u00ed odpov\u011bdnost. Provozovatel fitness centra nenese odpov\u011bdnost za p\u0159\u00edpadn\u00e1 zran\u011bn\u00ed, kter\u00e1 si n\u00e1v\u0161t\u011bvn\u00edk zp\u016fsob\u00ed v prostor\u00e1ch posilovny, a\u0165 ji\u017e p\u0159i cvi\u010den\u00ed, v souvislosti s n\u00edm, nebo mimo n\u011bj, nehled\u011b na to, zda si zran\u011bn\u00ed p\u0159ivod\u00ed p\u0159i cvi\u010den\u00ed s vyu\u017eit\u00edm cvi\u010debn\u00edch za\u0159\u00edzen\u00ed \u010di pom\u016fcek Provozovatele. Ka\u017ed\u00fd n\u00e1v\u0161t\u011bvn\u00edk ji\u017e samotn\u00fdm vstupem do prostor posilovny potvrzuje, \u017ee byl ze strany Provozovatele sezn\u00e1men s provozem posilovny, s jednotliv\u00fdmi cvi\u010debn\u00edmi za\u0159\u00edzen\u00edmi a pom\u016fckami a s t\u00edm, jak se pou\u017e\u00edvaj\u00ed, p\u0159i\u010dem\u017e v\u0161em t\u011bmto skute\u010dnostem a okolnostem n\u00e1v\u0161t\u011bvn\u00edk rozum\u00ed. V p\u0159\u00edpad\u011b, \u017ee si s obsluhou a vyu\u017eit\u00edm cvi\u010debn\u00edch pom\u016fcek nev\u00ed rady, obr\u00e1t\u00ed se pro pomoc na tren\u00e9ra \u010di jinak odborn\u011b zp\u016fsobil\u00e9 osoby, kter\u00e1 je p\u0159\u00edtomna na recepci hotelu a m\u016f\u017ee z\u00e1kazn\u00edk\u016fm poskytnout p\u0159\u00edslu\u0161nou podporu. Z\u00e1kazn\u00edk si rovn\u011b\u017e m\u016f\u017ee (za \u00faplatu dle aktu\u00e1ln\u00edho cen\u00edku) vy\u017e\u00e1dat asistovan\u00fd tr\u00e9nink (cvi\u010debn\u00ed pl\u00e1n) s tren\u00e9rem. N\u00e1v\u0161t\u011bvn\u00edk\u016fm nen\u00ed dovoleno si do prostor fitness centra p\u0159iv\u00e9st vlastn\u00edho fitness tren\u00e9ra.\r\n2. Z\u00e1kazn\u00edci nesm\u00ed vyu\u017e\u00edvat prostory fitness centra k vlastn\u00ed komer\u010dn\u00ed v\u00fdd\u011ble\u010dn\u00e9 \u010dinnosti, tj. zejm\u00e9na si do prostor fitness centra vodit vlastn\u00ed klienty a poskytovat jim osobn\u00ed fitness tr\u00e9ninky, pokud se s Poskytovatelem p\u0159edem nedohodnou jinak.\r\n3. N\u00e1v\u0161t\u011bvn\u00edci nejsou opr\u00e1vn\u011bni nosit do prostor fitness centra vlastn\u00ed n\u00e1poje a konzumovat vlastn\u00ed potraviny.\r\n4. N\u00e1v\u0161t\u011bvn\u00edk je povinen respektovat pokyny osob jednaj\u00edc\u00edch v zastoupen\u00ed Poskytovatele (osoby p\u0159\u00edtomn\u00e9 na recepci hotelu) a dodr\u017eovat ve\u0161ker\u00e1 pravidla a povinnosti stanoven\u00e9 t\u011bmito podm\u00ednkami.\r\n5. Pro vstup na organizovan\u00e9 lekce pod veden\u00edm tren\u00e9r\u016f se vy\u017eaduje (s ohledem na omezenou kapacitu) p\u0159edchoz\u00ed on-line nebo telefonick\u00e1 rezervace voln\u00e9ho term\u00ednu. Rezervaci term\u00ednu lze bez sankce zru\u0161it do 6 hodin p\u0159ed jej\u00edm zah\u00e1jen\u00edm; pokud je lekce zru\u0161ena pozd\u011bji, \u00fahrada za \u00fa\u010dast na ni propad\u00e1 (ode\u010dte se z permanentky, p\u0159\u00edp. z kreditu), a to bez ohledu na d\u016fvod, pro kter\u00fd se z\u00e1kazn\u00edk nez\u00fa\u010dastnil. \u010c\u00e1stka, kterou je storno zpoplatn\u011bno, odpov\u00edd\u00e1 cen\u011b organizovan\u00e9 lekce bez zohledn\u011bn\u00ed slevy, kter\u00e1 je z\u00e1kazn\u00edkovi v z\u00e1vislosti na jeho podm\u00ednk\u00e1ch poskytov\u00e1na (storno poplatek tedy m\u016f\u017ee b\u00fdt vy\u0161\u0161\u00ed, ne\u017e \u010d\u00e1stka, kterou by z\u00e1kazn\u00edk za vyu\u017eit\u00ed organizovan\u00e9 lekce zaplatil).\r\n6. Z\u00e1kazn\u00edci fitness centra jsou povinni chovat se tak, aby nedo\u0161lo ke vzniku \u017e\u00e1dn\u00fdch \u0161kod na majetku Provozovatele \u010di na zdrav\u00ed ostatn\u00edch z\u00e1kazn\u00edk\u016f a sou\u010dasn\u011b jsou povinni chovat se tak, aby vzniku takov\u00fdch p\u0159\u00edpadn\u00fdch \u0161kod p\u0159edch\u00e1zeli.\r\n7. Ka\u017ed\u00fd z\u00e1kazn\u00edk fitness centra je povinen se bezprost\u0159edn\u011b po vstupu do prostor posilovny u vchodu vyzout a obout se do \u010dist\u00e9 sportovn\u00ed obuvi, jej\u00ed\u017e podr\u00e1\u017eka nezanech\u00e1v\u00e1 \u017e\u00e1dn\u00e9 stopy.\r\n8. Ka\u017ed\u00fd z\u00e1kazn\u00edk fitness centra je povinen dodr\u017eovat b\u011b\u017en\u00e1 z\u00e1kladn\u00ed hygienick\u00e1 pravidla (zejm\u00e9na pak i v prostor\u00e1ch \u0161aten, sprch a toalet) spojen\u00e1 se sportovn\u00ed aktivitou a s vyu\u017eit\u00edm p\u0159\u00edstroj\u016f a pom\u016fcek provozovatele ur\u010den\u00fdch k vyu\u017eit\u00ed p\u0159i sportu. V prostor\u00e1ch posilovny jsou k dispozici dezinfek\u010dn\u00ed prost\u0159edky, s jejich\u017e vyu\u017eit\u00edm je ka\u017ed\u00fd n\u00e1v\u0161t\u011bvn\u00edk povinen odpov\u00eddaj\u00edc\u00edm zp\u016fsobem o\u010distit po ukon\u010den\u00ed cvi\u010den\u00ed j\u00edm pou\u017eit\u00e1 sportovn\u00ed n\u00e1\u010din\u00ed, stroje apod. Ka\u017ed\u00fd z\u00e1kazn\u00edk fitness centra je povinen po\u010d\u00ednat si ohledupln\u011b k ostatn\u00edm n\u00e1v\u0161t\u011bvn\u00edk\u016fm a neobt\u011b\u017eovat je nep\u0159im\u011b\u0159en\u00fdm hlukem \u010di z\u00e1pachem.\r\n9. Ka\u017ed\u00fd n\u00e1v\u0161t\u011bvn\u00edk posilovny je povinen po skon\u010den\u00ed cvi\u010den\u00ed vr\u00e1tit j\u00edm pou\u017eit\u00e1 sportovn\u00ed n\u00e1\u010din\u00ed a pom\u016fcky na jejich k tomu ur\u010den\u00e9 m\u00edsto (uklidit je).\r\n10. Ka\u017ed\u00e9mu n\u00e1v\u0161t\u011bvn\u00edkovi posilovny je k dispozici bar. Ka\u017ed\u00fd n\u00e1v\u0161t\u011bvn\u00edk posilovny je povinen po skon\u010den\u00ed cvi\u010den\u00ed j\u00edm p\u0159\u00edpadn\u011b pou\u017eit\u00e9 sklenice na pit\u00ed a dal\u0161\u00ed n\u00e1dob\u00ed uklidit na recepci.\r\n11. Zjist\u00ed-li kter\u00fdkoliv n\u00e1v\u0161t\u011bvn\u00edk posilovny jakoukoliv z\u00e1vadu \u010di po\u0161kozen\u00ed jak na objektu posilovny, tak na v\u011bcech v posilovn\u011b um\u00edst\u011bn\u00fdch, je povinen o tom bezodkladn\u011b informovat Provozovatele prost\u0159ednictv\u00edm osoby p\u0159\u00edtomn\u00e9 na recepci fitness centra tak, aby mohla b\u00fdt z\u00e1vada bezodkladn\u011b vy\u0159e\u0161ena, p\u0159\u00edp. aby mohlo b\u00fdt ze strany poskytovatele zamezeno\/omezeno u\u017e\u00edv\u00e1n\u00ed vadn\u00e9ho stroje. V p\u0159\u00edpad\u011b, \u017ee z\u00e1vadu zp\u016fsob\u00ed n\u00e1v\u0161t\u011bvn\u00edk, je povinen \u0161kodu Provozovateli v pln\u00e9 v\u00fd\u0161i nahradit.\r\n12. Posilovac\u00ed stroje se n\u00e1v\u0161t\u011bvn\u00edk zavazuje pou\u017e\u00edvat v\u00fdhradn\u011b k \u00fa\u010delu, ke kter\u00e9mu jsou ur\u010deny a zp\u016fsobem, kter\u00fd posilovac\u00ed stroj nepo\u0161kozuje. \u010cinky a jin\u00e1 z\u00e1va\u017e\u00ed je n\u00e1v\u0161t\u011bvn\u00edk povinen pou\u017e\u00edvat pouze v prostoru, kter\u00fd je k tomu vyhrazen (speci\u00e1ln\u011b upraven), a nesm\u00ed \u010dinky mimo tyto prostory vyn\u00e1\u0161et. P\u0159i zved\u00e1n\u00ed \u010dinek a jejich pokl\u00e1d\u00e1n\u00ed s nimi n\u00e1v\u0161t\u011bvn\u00edk nekontrolovan\u011b neh\u00e1z\u00ed a nespou\u0161t\u00ed je tak, aby ru\u0161il v\u0161echny v prostorech fitness centra hlukem z jejich odhazov\u00e1n\u00ed, p\u0159\u00edp. ni\u010dil podlahu fitness centra. N\u00e1v\u0161t\u011bvn\u00edk je povinen v\u017edy pou\u017e\u00edvat bezpe\u010dnostn\u00ed pojistky a uz\u00e1v\u011bry, pokud na posilovac\u00edch stroj\u00edch jsou.\r\n13. Ve v\u0161ech prostor\u00e1ch fitness centra (jak posilovna, tak \u0161atny, toalety, sprchy atd\u2026) je p\u0159\u00edsn\u00fd z\u00e1kaz konzumace alkoholick\u00fdch n\u00e1poj\u016f, omamn\u00fdch a psychotropn\u00edch l\u00e1tek a je v\u0161ude p\u0159\u00edsn\u00fd z\u00e1kaz kou\u0159en\u00ed.\r\n14. Do v\u0161ech prostor fitness centra je p\u0159\u00edsn\u00fd z\u00e1kaz vn\u00e1\u0161en\u00ed nebezpe\u010dn\u00fdch l\u00e1tek (jedy, v\u00fdbu\u0161niny, zbran\u011b, no\u017ee, chemik\u00e1lie, ho\u0159laviny atd.) a v\u0161ech ostatn\u00edch p\u0159edm\u011bt\u016f, kter\u00e9 jsou zp\u016fsobil\u00e9 ohrozit ostatn\u00ed n\u00e1v\u0161t\u011bvn\u00edky fitness centra. \r\n15. Na ukl\u00e1d\u00e1n\u00ed od\u011bv\u016f po dobu jejich p\u0159\u00edtomnosti ve fitness centru jsou n\u00e1v\u0161t\u011bvn\u00edk\u016fm k dispozici uzamykateln\u00e9 \u0161atn\u00ed sk\u0159\u00ed\u0148ky. P\u0159i odchodu z fitness centra je n\u00e1v\u0161t\u011bvn\u00edk povinen sk\u0159\u00ed\u0148ku vyklidit a odemknutou nechat k u\u017e\u00edv\u00e1n\u00ed dal\u0161\u00edm n\u00e1v\u0161t\u011bvn\u00edk\u016fm. Za ztr\u00e1tu, po\u0161kozen\u00ed \u010di zni\u010den\u00ed ulo\u017een\u00fdch v\u011bc\u00ed nese odpov\u011bdnost n\u00e1v\u0161t\u011bvn\u00edk. N\u00e1v\u0161t\u011bvn\u00edk bere na v\u011bdom\u00ed, \u017ee sk\u0159\u00ed\u0148ka slou\u017e\u00ed pouze a jen pro ukl\u00e1d\u00e1n\u00ed oble\u010den\u00ed. V p\u0159\u00edpad\u011b, \u017ee m\u00e1 n\u00e1v\u0161t\u011bvn\u00edk z\u00e1jem do dlouhodob\u00fd pron\u00e1jem sk\u0159\u00ed\u0148ky, je mo\u017en\u00e9 tak u\u010dinit na z\u00e1klad\u011b dohody s Poskytovatelem a za podm\u00ednek dle aktu\u00e1ln\u00edho cen\u00edku dostupn\u00e9ho na recepci fitness centra. U\u017eivatel sk\u0159\u00ed\u0148ky je povinen ji Poskytovateli na z\u00e1klad\u011b jeho \u017e\u00e1dosti kdykoli zp\u0159\u00edstupnit, aby Poskytovatel mohl zkontrolovat jej\u00ed obsah (zda neobsahuje nic, \u010d\u00edm by n\u00e1v\u0161t\u011bvn\u00edk poru\u0161oval tyto obchodn\u00ed podm\u00ednky, p\u0159\u00edp. obecn\u011b z\u00e1vazn\u00e9 pr\u00e1vn\u00ed p\u0159edpisy).\r\n16. Vn\u00e1\u0161en\u00ed cennost\u00ed, resp. hodnot, kter\u00e9 v sou\u010dtu maj\u00ed hodnotu nad 5.000,--K\u010d, do prostoru fitness centra je v\u00fdlu\u010dn\u011b na vlastn\u00ed nebezpe\u010d\u00ed a Poskytovatel takov\u00e9 vn\u00e1\u0161en\u00ed cennost\u00ed z\u00e1sadn\u011b nedoporu\u010duje. Ve v\u00fdjime\u010dn\u00fdch p\u0159\u00edpadech, je-li to nezbytn\u00e9, ulo\u017e\u00ed n\u00e1v\u0161t\u011bvn\u00edk cennosti u obsluhy u recepce, kde jsou um\u00edst\u011bny trezory, do kter\u00fdch budou takov\u00e9 cennosti po dobu cvi\u010den\u00ed n\u00e1v\u0161t\u011bvn\u00edka ulo\u017eeny. Za ztr\u00e1tu \u010di zni\u010den\u00ed takto vnesen\u00fdch cennost\u00ed, kter\u00e9 n\u00e1v\u0161t\u011bvn\u00edk neulo\u017e\u00ed v recepci dle p\u0159edchoz\u00ed v\u011bty, Poskytovatel v \u017e\u00e1dn\u00e9m ohledu neodpov\u00edd\u00e1.\r\n17. N\u00e1v\u0161t\u011bvn\u00edci fitness centra berou na v\u011bdom\u00ed, \u017ee za \u00fa\u010delem ochrany majetku Provozovatele, ochrany majetku n\u00e1v\u0161t\u011bvn\u00edk\u016f, ochrany \u017eivota a zdrav\u00ed n\u00e1v\u0161t\u011bvn\u00edk\u016f a za \u00fa\u010delem kontroly dodr\u017eov\u00e1n\u00ed provozn\u00edho \u0159\u00e1du fitness centra (pravidel pro chov\u00e1n\u00ed n\u00e1v\u0161t\u011bvn\u00edk\u016f uveden\u00fdch v t\u011bchto obchodn\u00edch podm\u00ednk\u00e1ch) instaloval provozovatel v prostor\u00e1ch posilovny kamerov\u00fd syst\u00e9m.\r\n18. Pro samostatn\u00fd vstup do posilovny je stanovena v\u011bkov\u00e1 hranice 18 let. Je-li osoba mlad\u0161\u00ed 18 let, je j\u00ed umo\u017en\u011bn p\u0159\u00edstup do posilovny pouze v doprovodu osoby star\u0161\u00ed 18 let, kter\u00e1 za d\u00edt\u011b p\u0159eb\u00edr\u00e1 plnou odpov\u011bdnost. Pro mal\u00e9 d\u011bti jsou prostory fitness centra nebezpe\u010dn\u00e9 a tud\u00ed\u017e nevhodn\u00e9. P\u0159ivede-li n\u00e1v\u0161t\u011bvn\u00edk posilovny mal\u00e9 d\u00edt\u011b, je povinen zamezit mu, aby se voln\u011b pohybovalo v prostoru posilovny, lezlo na posilovac\u00ed stroje, p\u0159\u00edp. ru\u0161ilo ostatn\u00ed n\u00e1v\u0161t\u011bvn\u00edky ve vyu\u017e\u00edv\u00e1n\u00ed slu\u017eeb posilovny. Pokud je ze strany Poskytovatele umo\u017en\u011bn p\u0159\u00edstup osoby mlad\u0161\u00ed ne\u017e 18 let (nap\u0159. na z\u00e1klad\u011b souhlasu z\u00e1konn\u00e9ho z\u00e1stupce), nep\u0159eb\u00edr\u00e1 Poskytovatel za tyto osoby \u017e\u00e1dnou odpov\u011bdnost (a to ani v r\u00e1mci organizovan\u00fdch skupinov\u00fdch hodin).\r\n19. Ke cvi\u010den\u00ed je ka\u017ed\u00fd n\u00e1v\u0161t\u011bvn\u00edk povinen pou\u017e\u00edvat sv\u016fj ru\u010dn\u00edk, kter\u00fd z hygienick\u00fdch d\u016fvod\u016f klade pod sebe na sedac\u00ed a op\u011brn\u00e9 plochy posilovac\u00edch stroj\u016f. Pokud si ru\u010dn\u00edk zapomene, m\u00e1 mo\u017enost si jej za poplatek vyp\u016fj\u010dit na recepci hotelu. V p\u0159\u00edpad\u011b, \u017ee ru\u010dn\u00edk n\u00e1v\u0161t\u011bvn\u00edk nepou\u017e\u00edv\u00e1, bude upozorn\u011bn na poru\u0161ov\u00e1n\u00ed povinnosti a v krajn\u00edm p\u0159\u00edpad\u011b m\u016f\u017ee b\u00fdt z prostoru fitness centra pro poru\u0161en\u00ed pravidel chov\u00e1n\u00ed vylou\u010den.\r\n20. V p\u0159\u00edpad\u011b, \u017ee kter\u00fdkoliv n\u00e1v\u0161t\u011bvn\u00edk posilovny poru\u0161\u00ed kteroukoliv povinnost uvedenou v tomto \u010dl\u00e1nku obchodn\u00edch podm\u00ednek, by\u0165 i jen v jednom p\u0159\u00edpad\u011b, je provozovatel opr\u00e1vn\u011bn trvale odep\u0159\u00edt a zamezit bez n\u00e1hrady p\u0159\u00edstupu tohoto n\u00e1v\u0161t\u011bvn\u00edka do prostor fitness centra. Tato skute\u010dnost mu bude ozn\u00e1mena i emailovou zpr\u00e1vou odeslanou na elektronickou adresu, pokud ji p\u0159i registraci uvedl.\r\n21. Pokud se n\u00e1v\u0161t\u011bvn\u00edk dopust\u00ed nevhodn\u00e9ho chov\u00e1n\u00ed v\u016f\u010di ostatn\u00edm n\u00e1v\u0161t\u011bvn\u00edk\u016fm, p\u0159\u00edp. v\u016f\u010di person\u00e1lu fitness centra, je Poskytovatel (nebo kter\u00e1koli j\u00edm pov\u011b\u0159en\u00e1 osoba) opr\u00e1vn\u011bn n\u00e1v\u0161t\u011bvn\u00edka vyk\u00e1zat z prostoru fitness centra jednor\u00e1zov\u011b, \u010di trvale, a to bez n\u00e1roku na n\u00e1hradu \u010di vr\u00e1cen\u00ed zaplacen\u00e9ho vstupn\u00e9ho (bez ohledu na jeho formu toto opat\u0159en\u00ed plat\u00ed jako pro permanentky, \u010dlenstv\u00ed, tak kradit). Takov\u00fdm jedn\u00e1n\u00edm se rozum\u00ed nap\u0159\u00edklad u\u017e\u00edv\u00e1n\u00ed hrub\u00fdch, ur\u00e1\u017eliv\u00fdch, zra\u0148uj\u00edc\u00edch a vulg\u00e1rn\u00edch slov, obt\u011b\u017eov\u00e1n\u00ed ostatn\u00edch n\u00e1v\u0161t\u011bvn\u00edk\u016f, neslu\u0161n\u00e9 a\u017e neuctiv\u00e9 nar\u00e1\u017eky na ostatn\u00ed n\u00e1v\u0161t\u011bvn\u00edky, p\u0159\u00edp. person\u00e1l atd..\r\n22. N\u00e1v\u0161t\u011bvn\u00edci jsou povinni ukon\u010dit svou \u010dinnost ve fitness centru tak, aby nejpozd\u011bji do konce otev\u00edrac\u00ed doby opustili prostor fitness centra (v\u010detn\u011b \u0161atny).\r\n23. Poskytovatel si vyhrazuje pr\u00e1vo upravovat podm\u00ednky pro vstup do fitness centra a pr\u00e1v a povinnost\u00ed p\u0159i \u010derp\u00e1n\u00ed slu\u017eeb v souvislosti s jeho provozem.\r\n24. Poskytovatel nezaji\u0161\u0165uje sv\u00fdm n\u00e1v\u0161t\u011bvn\u00edk\u016fm plnou kapacitu parkov\u00e1n\u00ed, n\u00e1rok na parkov\u00e1n\u00ed, \u010di jeho kompenzaci nevznik\u00e1.\r\n25. Poskytovatel neodpov\u00edd\u00e1 za jak\u00e9koliv \u0161kody na majetku \u010di zdrav\u00ed, kter\u00e9 si n\u00e1v\u0161t\u011bvn\u00edk zp\u016fsob\u00ed \u00famysln\u011b, z nedbalosti \u010di neopatrnosti, ani v souvislosti s p\u0159ecen\u011bn\u00edm jeho schopnost\u00ed \u010di podcen\u011bn\u00edm zdravotn\u00edho stavu. Neodpov\u00edd\u00e1 ani v p\u0159\u00edpad\u011b, kdy n\u00e1v\u0161t\u011bvn\u00edk nedodr\u017e\u00ed z\u00e1sady spr\u00e1vn\u00e9ho zach\u00e1zen\u00ed s n\u00e1\u010din\u00edm \u010di stroji a ohroz\u00ed t\u00edm (p\u0159\u00edp. zp\u016fsob\u00ed \u0161kodu \u010di \u00fajmu) jin\u00e9mu n\u00e1v\u0161t\u011bvn\u00edkovi.\r\n26. Poskytovatel si vyhrazuje pr\u00e1vo omezit \u010di roz\u0161\u00ed\u0159it otv\u00edrac\u00ed dobu fitness centra podle sv\u00e9ho vlastn\u00edho uv\u00e1\u017een\u00ed, je opr\u00e1vn\u011bn v od\u016fvodn\u011bn\u00fdch p\u0159\u00edpadech i provoz fitness centra do\u010dasn\u011b omezit \u010di p\u0159eru\u0161it. Zm\u011bny otv\u00edrac\u00ed doby nejsou d\u016fvodem pro poskytnut\u00ed jak\u00e9koli kompenzace n\u00e1v\u0161t\u011bvn\u00edk\u016fm, ani ke sn\u00ed\u017een\u00ed \u010di vr\u00e1cen\u00ed \u010dlensk\u00fdch poplatk\u016f, \u010di vyplacen\u00ed kreditu.\r\n27. V p\u0159\u00edpad\u011b mimo\u0159\u00e1dn\u00e9, nep\u0159edv\u00eddateln\u00e9 a nep\u0159ekonateln\u00e9 p\u0159ek\u00e1\u017eky, kter\u00e1 vznikla nez\u00e1visle na v\u016fli Poskytovatele (vy\u0161\u0161\u00ed moc) si Poskytovatel vyhrazuje pr\u00e1vo uzav\u0159\u00edt bez dal\u0161\u00edho fitness centrum, a to na dobu odpov\u00eddaj\u00edc\u00ed dan\u00e9 situaci (\u00fapln\u011b, \u010di \u010d\u00e1ste\u010dn\u011b) a p\u0159\u00edpadn\u011b ukon\u010dit \u010dlenstv\u00ed z\u00e1kazn\u00edk\u016f s okam\u017eitou \u00fa\u010dinnost\u00ed. N\u00e1rok na n\u00e1hradu \u010di vr\u00e1cen\u00ed ji\u017e zaplacen\u00fdch poplatk\u016f z\u00e1kazn\u00edkovi nen\u00e1le\u017e\u00ed. Z\u00e1kazn\u00edk bere na v\u011bdom\u00ed, \u017ee p\u0159\u00edpadn\u00e1 opat\u0159en\u00ed (vl\u00e1dy, ministerstva atd.) vyd\u00e1van\u00e1 v souvislosti s pandemi\u00ed COVID \u2013 19 se pova\u017euj\u00ed za vy\u0161\u0161\u00ed moc a postupuje se v souladu s t\u00edmto ustanoven\u00edm.\r\n28. V p\u0159\u00edpad\u011b, \u017ee nastane okolnost, kter\u00e1 do\u010dasn\u011b znemo\u017e\u0148uje Poskytovateli poskytnout slu\u017eby dle t\u011bchto obchodn\u00edch podm\u00ednek, nem\u00e1 toto vliv na pr\u00e1va a povinnosti z\u00e1kazn\u00edk\u016f a nen\u00ed d\u016fvodem pro sn\u00ed\u017een\u00ed \u010di vr\u00e1cen\u00ed zaplacen\u00e9 ceny za slu\u017eby ani \u010dlensk\u00fdch poplatk\u016f ani ukon\u010den\u00ed smlouvy ze strany z\u00e1kazn\u00edka. Za z\u00e1va\u017en\u00e9 probl\u00e9my se pova\u017euje nap\u0159. nedostate\u010dn\u00e1 kapacita fitness centra (nap\u0159. v d\u016fsledku omezen\u00ed kapacity na z\u00e1klad\u011b vl\u00e1dn\u00edch opat\u0159en\u00ed), p\u0159\u00edpadn\u011b technick\u00e9 probl\u00e9my, kter\u00e9 by vyu\u017eit\u00ed n\u011bkter\u00fdch slu\u017eeb omezily, \u010di vylou\u010dily.\r\n\u010cl\u00e1nek IV.\r\nOCHRANA OSOBN\u00cdCH \u00daDAJ\u016e\r\n1. Zpracov\u00e1n\u00ed osobn\u00edch \u00fadaj\u016f. Poskytovatel informuje z\u00e1kazn\u00edka, \u017ee zpracov\u00e1v\u00e1 pouze takov\u00e9 osobn\u00ed \u00fadaje o z\u00e1kazn\u00edkovi, kter\u00e9 jsou nezbytn\u00e9 k pln\u011bn\u00ed pr\u00e1v a povinnost\u00ed vypl\u00fdvaj\u00edc\u00edch pro prod\u00e1vaj\u00edc\u00edho ze z\u00e1kona a uzav\u0159en\u00e9 smlouvy mezi Poskytovatelem a z\u00e1kazn\u00edkem. P\u016fjde zpravidla o zpracov\u00e1n\u00ed t\u011bchto osobn\u00edch \u00fadaj\u016f: jm\u00e9no a p\u0159\u00edjmen\u00ed, adresa bydli\u0161t\u011b, adresa elektronick\u00e9 po\u0161ty, telefonn\u00ed \u010d\u00edslo.\r\n2. Osobn\u00ed \u00fadaje z\u00e1kazn\u00edka. Z\u00e1kazn\u00edk bere na v\u011bdom\u00ed, \u017ee je povinen sv\u00e9 osobn\u00ed \u00fadaje (p\u0159i registraci, ve sv\u00e9m u\u017eivatelsk\u00e9m \u00fa\u010dtu atd.) uv\u00e1d\u011bt spr\u00e1vn\u011b a pravdiv\u011b a \u017ee je povinen bez zbyte\u010dn\u00e9ho odkladu informovat Poskytovatele o zm\u011bn\u011b ve sv\u00fdch osobn\u00edch \u00fadaj\u00edch. Podrobn\u00e9 informace o zpracov\u00e1n\u00ed osobn\u00edch \u00fadaj\u016f ze strany Poskytovatele jsou uvedeny v dokumentu \u201eInformov\u00e1n\u00ed o zpracov\u00e1n\u00ed osobn\u00edch \u00fadaj\u016f\u201c, kter\u00fd je dostupn\u00fd na webov\u00fdch str\u00e1nk\u00e1ch prod\u00e1vaj\u00edc\u00edho www.fitness.olympland.cz.\r\n3. Kamerov\u00fd syst\u00e9m. Z\u00e1kazn\u00edk, jako n\u00e1v\u0161t\u011bvn\u00edk fitness centra bere na v\u011bdom\u00ed, \u017ee z d\u016fvodu ochrany pr\u00e1v a opr\u00e1vn\u011bn\u00fdch z\u00e1jm\u016f Poskytovatele (ochrana majetku, ochrana \u017eivota a zdrav\u00ed osob, kontrola dodr\u017eov\u00e1n\u00ed pravidel fitness centra atd.) a z d\u016fvodu ochrany n\u00e1v\u0161t\u011bvn\u00edk\u016f fitness centra, jsou ve cvi\u010debn\u00edch prostor\u00e1ch um\u00edst\u011bny kamery. Dokumentace kamerov\u00e9ho syst\u00e9mu je k dispozici k nahl\u00e9dnut\u00ed na recepci fitness centra. Hlavn\u00edm \u00fa\u010delem zaveden\u00ed kamerov\u00e9ho syst\u00e9mu je p\u0159\u00edpadn\u00e9 obstar\u00e1n\u00ed d\u016fkazn\u00edch prost\u0159edk\u016f pro eventu\u00e1ln\u00ed n\u00e1sledn\u00e9 jejich pou\u017eit\u00ed Poskytovatelem k ochran\u011b a uplatn\u011bn\u00ed jeho opr\u00e1vn\u011bn\u00fdch z\u00e1jm\u016f (ochrana majetku Poskytovatele, ochrana \u017eivota a zdrav\u00ed osob vyu\u017e\u00edvaj\u00edc\u00edch samoobslu\u017en\u00e9 fitcentrum, poru\u0161ov\u00e1n\u00ed pravidel pro u\u017e\u00edv\u00e1n\u00ed fitcentra a s t\u00edm souvisej\u00edc\u00edm vznikem nebezpe\u010d\u00ed ve vztahu jak k osob\u00e1m, tak k majetku Poskytovatele) a k n\u00e1sledn\u00e9mu vyu\u017eit\u00ed z\u00edskan\u00fdch \u00fadaj\u016f\/d\u016fkaz\u016f k uplatn\u011bn\u00ed pr\u00e1vn\u00edch n\u00e1rok\u016f Poskytovatele p\u0159ed org\u00e1ny Polici\u00ed \u010cR (v\u010detn\u011b dal\u0161\u00edch org\u00e1n\u016f ve\u0159ejn\u00e9 spr\u00e1vy) p\u0159i odhalov\u00e1n\u00ed p\u00e1ch\u00e1n\u00ed trestn\u00e9 \u010dinnosti a p\u0159estupk\u016f, p\u0159\u00edp. p\u0159ed poji\u0161\u0165ovnou. S ohledem na hodnoty, kter\u00e9 jsou chr\u00e1n\u011bny prost\u0159ednictv\u00edm monitoringu kamerov\u00fdm syst\u00e9mem (zdrav\u00ed a \u017eivot n\u00e1v\u0161t\u011bvn\u00edk\u016f fitcentra, ochrana majetku Poskytovatele proti kr\u00e1de\u017ei, p\u0159\u00edp. zni\u010den\u00ed), a s ohledem na rozsah a hodnotu majetkov\u00fdch hodnot Poskytovatele se vyu\u017eit\u00ed monitoringu prost\u0159ednictv\u00edm kamerov\u00e9ho syst\u00e9mu jev\u00ed jako p\u0159im\u011b\u0159en\u00e9, a to i p\u0159i zohledn\u011bn\u00ed ochrany pr\u00e1v a opr\u00e1vn\u011bn\u00fdch z\u00e1jm\u016f n\u00e1v\u0161t\u011bvn\u00edk\u016f fitness centra Poskytovatele na ochranu soukrom\u00ed a osobn\u00edch \u00fadaj\u016f, kter\u00e9 jsou v r\u00e1mci v\u0161ech p\u0159ijat\u00fdch opat\u0159en\u00ed \u0161et\u0159eny v maxim\u00e1ln\u00ed mo\u017en\u00e9 m\u00ed\u0159e. Poskytovatel m\u00e1 za to, \u017ee prost\u0159ednictv\u00edm provozu kamerov\u00e9ho syst\u00e9mu dojde i k podstatn\u00e9mu zv\u00fd\u0161en\u00ed bezpe\u010dnosti n\u00e1v\u0161t\u011bvn\u00edk\u016f a zamezen\u00ed pohybu ciz\u00edch osob (neopr\u00e1vn\u011bn\u00fdch osob) ve fitness centru Poskytovatele. N\u00e1v\u0161t\u011bvn\u00edk vzal na v\u011bdom\u00ed, \u017ee kamerov\u00fd syst\u00e9m je v prostor\u00e1ch fitness centra pou\u017e\u00edv\u00e1n a vstupem do fitness centra a vyu\u017e\u00edv\u00e1n\u00edm jeho slu\u017eeb souhlas\u00ed s um\u00edst\u011bn\u00edm kamerov\u00e9ho syst\u00e9mu, jeho vyu\u017eit\u00edm a zpracov\u00e1n\u00edm osobn\u00edch \u00fadaj\u016f pro pot\u0159eby uveden\u00e9 v tomto odstavci.\r\n\u010cl\u00e1nek V.\r\nDORU\u010cOV\u00c1N\u00cd\r\nKupuj\u00edc\u00ed souhlas\u00ed s t\u00edm, \u017ee komunikace mezi prod\u00e1vaj\u00edc\u00edm a kupuj\u00edc\u00edm bude prob\u00edhat mimo jin\u00fdch zp\u016fsob\u016f i elektronicky, prost\u0159ednictv\u00edm mailov\u00e9 adresy, kterou kupuj\u00edc\u00ed uvede p\u0159i uzav\u00edr\u00e1n\u00ed kupn\u00ed smlouvy. Tato komunikace se pova\u017euje za dostate\u010dnou.\r\n\u010cl\u00e1nek VI.\r\nZ\u00c1V\u011aRE\u010cN\u00c1 USTANOVEN\u00cd\r\nPoskytovatel informuje z\u00e1kazn\u00edka, \u017ee z\u00e1kazn\u00edk (jako\u017eto spot\u0159ebitel) m\u00e1 pr\u00e1vo na mimosoudn\u00ed \u0159e\u0161en\u00ed spot\u0159ebitelsk\u00e9ho sporu, kter\u00fd by vznikl v souvislosti se smlouvou uzav\u00edranou na z\u00e1klad\u011b t\u011bchto obchodn\u00edch podm\u00ednek. Subjektem mimosoudn\u00edho \u0159e\u0161en\u00ed spot\u0159ebitelsk\u00fdch spor\u016f je \u010cesk\u00e1 obchodn\u00ed inspekce.
